What Landlords Need to Know About Upcoming Housing Legislation Changes
Important changes to Scotland’s private rented sector are coming into force on 6 October 2026 under the Housing (Scotland) Act 2025.
Here’s what landlords need to know:
Awaab’s Law
New duties will apply when tenants report damp and mould. Landlords will need to investigate reports within 10 working days, provide the tenant with written findings within 3 working days, and, where substantial damp or mould is identified, begin necessary repairs within 5 working days of the investigation being completed.
Keeping accurate records of reports, inspections, communications and repairs will be particularly important.
Tenancy succession
The qualifying period for certain people to inherit a Private Residential Tenancy following the death of a tenant will reduce from 12 months to 6 months.
Wrongful termination payments
The amount that can be awarded by the First-tier Tribunal where a tenancy has been wrongfully terminated will increase significantly, with awards generally ranging from 3 to 36 times the relevant monthly rent.
What should landlords do?
With these changes coming into effect shortly, landlords should review their current procedures, ensure they have reliable contractors available for repairs, maintain clear records and make sure their tenancy documentation is up to date.
